Naked news affiliate program update
 
Just got this in from naked news.. OMG are they for real?

Attention Affiliates:

We want to highlight Section 5 of our Terms and Conditions for The Naked News Affiliate Program (http://affiliates.nakednews.com)

Please read the following and contact us with any questions or concerns.

Without the express written consent of eGalaxy Multimedia Inc, the Affiliate will do nothing that will actively seek or encourage Internet search engines to list the Affiliate (or anyone directly or indirectly related to the
Affiliate) under the search words "naked news" "nakednews" "nakednews.com"
"nakednewsdailymale.com" "nakednewsdailymale" "daily male" or "naked"
[with or without spaces between the words] (hereinafter called the "Search Engine Terms") or under any other term which may be confusingly similar to the Search Engine Terms. This includes, but is not limited to, using meta tags, tag lines, keywords, bookmarks, gate way pages, door way pages, word embedding, and feeder sites.

Affiliate may use only content, pictures and videos supplied by us, including banners, videos and may employ TGP (Thumb Gallery Post) specifically approved by us in writing. Any use of unauthorized content is strictly prohibited.

If Affiliate does receive a search engine listing for any of the Search Engine Terms, Affiliate shall immediately on discovery of same, or on notification from eGalaxy Multimedia Inc., cause the reasons for such listing to be removed from the Affiliate's site(s) and shall further advise the applicable search engine to remove such listing for any of the Search Engine Terms, and failing such immediate action, the Affiliate hereby irrevocably grants to the eGalaxy Multimedia Inc.
full and complete authority and power of attorney, in the Affiliate's name or otherwise to do anything reasonably required to remove the search engine listing for any of the Search Engine Terms.

If you do break these policies you will not get paid and you will receive a notice from our Legal Department with instructions on how to rectify the situation and change your pages. If you do not respond to that email in a timely fashion we will seek damages.

Are you allowed to wipe your own ass, or do they need to approve of that as well?

Doesn't sound like they are horribly appreciate of their affiliates' abilities to draw search engine traffic to their program. I could understand them not wanting you to use their terms to promote a competitor, but they're not letting you do squat to promote THEM.

It should read like this: "Do not mention our name when promoting us".

At least they aren't claiming a trademark for the word 'naked' yet.

|pokefun| What a horribly misguided affiliate policy.

They are attempting to monopolize certain keywords by not allowing their own affiliates to use them and forcing them to change their pages if they get listed - lol

This also gives them a great loophole to not pay affiliates (this is not to hate or suggest that they do not pay, just a contract review comment)

We love affiliates that get search engine placements for our sites. I would rather pay affiliates than Google...

What a bunch of assholes.

1. You cannot give someone power of attorney by clicking a box that says "I agree to the terms and conditions."

2. If a page promoting their site comes up for search terms that they in fact use to promote their site, why do they give a fuck if it's still their program that's being promoted?

3. I didn't know Hitler ran an affiliate program.

Playboy has the same thing & Mr Skin's terms state you're not allowed to knowingly attract SE terms for celebs, so this does sorta make sense to me.

Of course, this is coming from a guy that had Penthouse send him a C & D in 1998 :D

I can understand them trying to control trademarked terms, but they're saying you can't use the terms "naked news" or "naked".

Huh? So...if you have awesome celeb rankings they don't want you to promote them?

Copyright stuff is very understandable, but generic celeb names should really only be the actually celebs beef.

Not that I care much...just an observation.

grandmascrotum - assuming that they have a copyright on the term "naked news" then they are just protecting their term. And you know it's not really directed at legit webmasters that are promoting them - it's more directed at all the shit SE spammers out there, along the lines of an official warning so that when someone does get sued, they can reference this info & whatnot.

Alphawolf - I don't have the email they sent out on that last year, but it sounded something along the lines of they were trying to cover their asses in case a celeb tried to sue them because an affiliates SE listings were coming up when that celebs name was searched.

NOTICE
Please be aware that the Naked News Affiliate Program will
discontinue service today, February 18th at 5:00pm EST.
The Naked News would like to thank each affiliate who has
participated in the Program. Due to the closure of the program every
affiliate is required to immediately remove all links and images
pertaining to the Naked News from their websites. Any materials used
for the promotion of the Naked News are the property of the Naked
News and must be removed immediately. This is not limited to images
or direct links but also includes any and all use of the term Naked
News in URLs, meta-tags, alt tags, title tags or other html, related
web code and all web pages targeting search engines MUST be taken
down immediately.
All affiliate earnings accrued and owing to February 18, 5:00pm EST
will be paid to affiliates as per the regular pay schedule (March
7th, 2005).
If you have any questions regarding the Naked News Affiliate Program
please contact affiliates@nakednews.com

HMMMMM....I suspect after that bullshit this thread was started over they may have seen a tiny drop in affiliate traffic :D
