2257 Question
 
I was just wondering... from those who have read the new 2257 law, how my site would fall. I run an amateur site in which people submit their photos to me. I take it from what I read, this would basically make me a secondary producer, just like in the affiliate situation. Getting model releases might be a little difficult, since I'm sure that these guys don't ask their wivess to sign a model release when they are snapping pics of them getting banged in the bedroom.

Also, does the 2257 rules apply where the hardcore content is behind a pay site and there is no hardcore photos publically available? Because esentially, if a 10 years old steals a credit card and says he is 18 and goes to a porn site, what can you do? That is like the kid looking at his dad's Playboy mags. Since his dad has the Playboy, wouldn't he be required to have all of the models information since he is in possesion of the photographs that can be shown to other people?

User submitted photo sites are the worst case scenario. You can't possibly make one legal.

2257 applies to all content published to the internet, even if behind an access control system.

If you're posting pics that people submit to you without any documentation, then forget about the new 2257 - you're breaking the law as it stands now :(

Oh well... I just guess I'm fucked, because I don't really see how I am going to get several thousand people to send me all of their info and copies of their photo IDs. Plus, having to make a copy of thousands of pages on the site and cross reference them to the model info... |cry|

Would Koolkats situation be similar to what AFF, sexsearch etc will have to deal with? Will they be required to get all the info for each photo uploaded?

Heres an idea.

Find a webhost, ISP, not IPP, make a deal for virtual sites and domain names that you can retail to your posters for less than 10 bucks.

When your poster uploads, have the poster upload to their new virtual website and link the pictures from there.

Take a small commission on the virtual hosting, or credit for your dedictated server, and make some extra money.

Just a thought.

Yes this is a big problem for amateur (non-model) websites and adult personals sites.
To be honest, it would be easier for me to find a server in a foreign country, a foreign processor, and and keep my money in a foreign bank account... that way the US doesn't have any jurisdiction over it. I work very hard to prevent even copyrighted material from appearing on my site, least be am I going to allow CP!
