how to License a Script ?

i am looking for some advice
i hired some guy to write me few scripts
that i am planning to put on market as soon all testing will be done, my question is what kind of license i need to get from him or from any other place to protect myself from every possible asspect ?

Depends on the original contract that he signed with you. If it says that all work product that he produces is the property of your company, its pretty straight-forward.

If he custom designed a script to sell to you and undercut his rates with the thoughts of reselling the script, you might run into more difficulty. If you bought a script from him and had it customized, then, that would make it a lot more difficult.

Its should be documented clearly in the work document & quote.

Best thing to do would be to ask him what his expectations are.

well we didnt signed any contract and this not costumization of script, he write it from scratch as this person is not company he wont have any problems signing one :)
any one knows where can i get a standart license to make him sign it ?

You might try lawdepot.com for some blanket agreement. Maybe guru.com or rentacoder.com or one of those other sites will have some standard engagement agreement.

Probably cost a few $$ on lawdepot.com to get what you need -- I didn't see anything that specifically addressed what you wanted. Some of the open source licenses might have resources that they point to: opensource.org might be a starting point, but that is more a license agreement for software you have produced.

Even most employment contracts have wording that permits you to obtain the use of the script, patent, etc.

Bear in mind that the developer owns the copyright, and just grants you permission for whatever uses.

now for the last question do i need some kind of commercial license so i can sell my script or some kind of trademark ?

License = No, but handy!
Trademark = No, but nice, but expensive!
