Again, I can't blame anyone that signs an agreement with Acacia. They need to look out for their own interest. When Paul Markham was on the radio, I asked if Acacia won in court, would the payments be retroactive. He didn't answer me. So, I went to the horses mouth. And yes, payments would be retroactive.

Do You have any idea how much money that would equate to with the larger, older sponsors out there today? It could and would put many out of business.

I believe in fighting the good fight but I can never find fault for sponsors looking out for their asses.

It seems that everyone just thinks about the small picture when someone settles. Take a look at the big picture and try thinking of the possibility of having to pay Millions later or Thousands now.

We will and have fought Acacia but, don't blame sponsors that do see the big picture and want to stay in business if the case fails.

you are the voice of reason.. but Acacia keep sending their emails of "approved" sponsors. Then they say they won't come after you if you only use those sponsors... catch 22.

This will always be a tough area, we discussed this in our office breifly today.

Ive known Kevin and use to do very well with Top Bucks before I started my own ventures, he's a great guy, very nice and has an excellent staff along with him. Im sure it wasnt the easiest decision for him to make, and Im positive he isnt thrilled about it by any means, but as Jim said, Top Bucks needs to do whats right for their longevity, their family, employee's, long term business parnters and their affiliates. Im sure all of that was considered, and Im not saying I agree with or disagree with their decision. Even Spike from Homegrown will tell you, you need to do whats in your best intrest, this was exactly that, for whatever reason, perhaps a deal that couldnt be refused, who knows, either way they did what they felt was best for them, and I respect that.

Maybe they can claim their money back somehow if acacia fails in court.....|lightsabe

Maybe we should buy some of their stock and sell it just before the court day. Assuming they lose in court their stock should drop like a rock.

It is easy to bitch about sponsors that settle when they have nothing to lose. But the sponsors have everything to lose. And, they have many smart lawyers that tell them the best thing to do is to settle now before the court decides to uphold the patent and then sponsors will be paying retroactively.

You can bet your ass, if I still ran Ultracash and received paperwork and started doing the figures on when we started using streaming video, I would settle. There is just too much to lose not to.

There have always been two types of people.

People that decided they didn't want to be under the rule of the queen, those that dumped tea into the bay, people who got tired of sitting in the back of the bus and drinking from seperate water fountains, those that decided they should be paid and treated equally as the men.

People that stand up and fight for what they feel is right, where principle means more to them than the possible consequences.

Then there are those that are afraid to rock the boat, people who will always follow, roll over and play dead.

The world needs both types of people for everything to balance out and work.
