Vivid Entertainment Says Do-It-Yourself Porn Site Unfair

The latest online copyright battle doesn't involve pirated music or movies, but X-rated videos.

Adult video producer Vivid Entertainment is suing PornoTube and its parent company in federal court.

PornoTube is a YouTube knockoff that allows users to post X-rated video clips.

Vivid claims some of those short sex clips are from its copyrighted, full-length videos.

Vivid said it is required by law to record the ages and birth names of its performers. The suit claims PornoTube has an unfair competitive advantage because it doesn't always have to do that sort of paperwork.

There was no immediate comment yet from the PornoTube camp.

Just one major glitch in your plan. Rapidshit isn't a US based site. The only way to go after those asswipes is to attack their income sources.

Is PornoTube a separate entity of AEBN? And if it isn't, doesn't AEBN own the rights to a ton of Vivid content?

Yes, PornoTube is part of the larger corp. that includes AEBN, and AEBN does have a content usage contract in place with AEBN. That's going to complicate issues if/when this goes to trial.

And to me it doesn't seem like a great business move on Vivids part. There are a lot of tube sites out there that have Vivid content. Why go after the one that you do so much business with?

Something just seems strange about it.

Because they actually have the assets to pay any award granted by the court.

Well, it has been suggest that this is really just hype to get the topic into the media to get the attention of all those other tube sites. If true, then AEBN may be in on the plan, and they'll come to an unspecified "negotiated settlement" without ever going to trial.

Porno Tube is probably the biggest, so that's why they are going after them (sorta like every news story about social networking websites always refer to MySpace & none of the million other ones)

I'd think that AEBN does have the rights to use some Vivid content, but I'd bet they only have the rights to use it on certain domains or in certain ways (and this ain't one of them)

But what do I know..........:)
