Help , i am SUED

Some years ago i used a page generator to make doorway websites.
And i used another tool ti find popular keyword phrases.

In short i used the term " pottery barn" in the heading at some of those pages and this have a trademark.

Read about it here:
http://209.85.135.104/search?q=cache...ent.html/2993/

When i knew about this case, removed the sites with that term "pottery barn"
Hope to get some good advise about this case.

Why would you use the term "pottery barn" on an adult website?! That's a high-end home furnishing store here in the US. Not sure how that relates to internet porn. |crazy|

Dang... the scary part here is they are now allowing service of the court documents via email as well as international postal mail in some countries instead of personal service. Lack of knowledge of the English language or what meta tags are is not going to protect anyone.

Why would you have any trademarked name in a meta-tag to begin with, especially one that does not have anything to do with porn in any way? Even if you used a generator, you could/should have looked at the code you were taking responsibility for.

Good lesson here...

Why i put the term on the site..
I was in a hurry and grabbed a bunch of keywords, thats how it got there...
And for me its impossible to know that that term have a trade mark.I had no idea about that, and i removed this as soon i was aware of it.

they had to have sent you a few emails and letters and I am assuming you just ignored them or had BS info on your domain registrant

I am sorry but i have no sympathy for you. Its webmasters like yourself that give the rest of us a bad name

|bullshit| Im going to call bullsh*t on the fact you didn't know the keywords were there. That tactic has been around for years, using popular non-adult terms, or terms that relate to hot topics to generate higher search engine placement..especially when making mirrored doorway pages. And as mentioned in this thread already, you would have been contacted in regard to a lawsuit long before you were hit with any papers. Also mentioned - get a lawyer |thumb

This thread title should read "Help, I am SCREWED!" :D

Sorry to hear about your problem but I'm with Tommy on this one. They always send a DMCA or at least an email and you didn't respond or didn't get it due to the wrong info. I'd gotten them regarding celeb content and always respond and remove it right away. Never ever fuck with these guys or any trademark stuff. Not worth it!

Some years ago I thought I could make some money off of MTV's Real World, it didn't take long for them to hand deliver a Cease and Desist Letter to me.
I contacted a Lawyer and he assured me that if I didn't pull the web site immediately they would own everything I had and everything I made for the rest of my life

I'm agree with the rest of the folks. Get a lawyer.

Also I'm not overly impressed with the site in your signature.|badidea|

Well, I agree that he was at least irresponsible, at least with having domains with the wrong contact info, if nothing else. That said, I'm not sure how they expect non-Americans to know that this was a brand name. In that case, I think a good lawyer may have a chance at fighting this off. I think a lot may depend on where the trial will take place.

No Bs info on my domain, i resonpoded to the very first email i got from them, letting them know that i pulled all the sites that have their trademark word..
But they did ignore my replies every time i email them, only send me copies of the california cort letters.
And yes i will get a lawyar if this some day will go to cort here in norway.

Indeed. This is the first time I've ever heard of pottery barn. When I first read it, I thought it was a generic term used for pottery that was made in a barn!

That said, like others have said... you do have a responsibility to at least check the code you are putting on your site.
