So, what do folks know about the gotys - cliphunter - pink visual lawsuit?

So, anybody have any new news on the 4.5 mil lawsuit by pink visual against gotys and cliphunter?

http://newswire.xbiz.com/view.php?id=150974
LOS ANGELES — Pink Visual has filed a $4.5 million lawsuit against the operator of ClipHunter.com, charging that the tube site has streamed 30 of its titles in a coordinated scheme to generate mass web traffic and then monetize it.
The suit targets operator Justin Eleazer, as well as several companies he controls — Green Park Holdings and Gotys Productions — over the Pink Visual videos that allegedly ended up on the ClipHunter.com. Eleazer also is said to control PicHunter.com and PicHunterBlog.com.
Pink Visual maintains in the suit that ClipHunter, which reaches about 600,000 to 1 million surfers in the U.S. per day, enables users to upload and obtain copies of a vast library of infringing adult video content for free and that it first noticed copies appearing on its site in April.
"Defendants appear to maintain the fiction that they offer a forum for users to upload and share their own original 'user-generated' adult video content; however, in reality, they function as repositories for large collections of copyrighted, professionally made adult videos ...," the suit said.
The goal, Pink Visual counsel says, is to capitalize on the mass web traffic it creates.
Coincidentally, I just learned I have multiple distant connections to gotys, or rather, the guy, or one of the guys, behind the gotys nick.

I dream of the death of the tubes...

lezinterracial 2013-02-15 08:53 PM

Step in the right direction. The only thing that bothers me is all these tube that are based overseas.

Correct me if I am wrong on the following.
Private Video tried to sue Xhamster but couldn't figure out who they were and sued whoisguard instead.

ManWin owns pornhub. Manwin has become so powerful they have lawyers that are so good that could face down Disney lawyers.

Tube sites will never go away, even if search engines stopped liking them.

It's the sharing of any media on any site that is not created or licensed by an individual or website that is the issue, if there is a way to stop or make this illegal it could curtail some of these issues.

Any website found to have content not created by them, licensed by them or written permision from said owner should have the website blocked in the US.

Of Course, that opens up another can of worms that I don't think I want either.

Catch 22!

Google stock up over $800 a share. Does it have anything to do with their announcement or rather announcement made for them about teaming with cc companies not to process for illegal sites?

This will probably be settled prior to reaching trial. That has been Pink Visual's tactic with prior similar suits. They're primary focus isn't shutting down the tube sites, it's getting paid for use of their content.

Didn't Manwin settle with them out of court too? I think PornHub was the first company they sued before the old owners sold to the current guy. Another big reason the old owners wanted out.

Now Manwin protects itself behind DMCA laws just like YouTube does.

well, as I have heard it, gotys is still being sued, and the other cliphunter owners have abandoned him. If you read the available court filings, it sounds like he is evading the process servers.

http://archive.recapthelaw.org/cacd/536540/

I know people who know him, and have been working on a website that was made, and fucked up, by his mainstream web development company - they were telling me some of the inside details.

I am loathe to repeat them, in case they are not true.

It was just a wierd sequence - first a strip club owner who is a friend wa stelling me gotys stories, then, the very next daym as I am working on a nonprofit website move for another friend, I realize the sites theme was made by gotys's company - it was oddly cripwared, clearly he was worried about getting paid by the contractor, a big website name in my area.

It's all a wild story, maybe someday I can tell it all.

Is TarPy gotys or was he one of the other John Doe's?

Tarpy was the main kid that ran the sites. Gotys was from Czech or somewhere over there. And Tom, 3xlinks I think he was called, also helped run the site before he got heavily involved in Jaymancash and Raven Riley.

HowlingWulf 2013-02-22 10:48 AM

I wonder if this will affect pichunter as well...

Bill 2013-02-23 12:19 AM

gotys may or may not be czech, but the guy being sued as gotys, Justin E., sure as fuck don't live in czeheslovokia.

I recently learned that a settlement has been arranged, but not concluded, with Pink Visual, but, that there is another suit as well.

tubes not tubes... have imagined tubes 7 years ago when one gallery posted to hun was bringing you 5 sales? me not : )

but now it's kind of reality and just yesterday i had thought that live cams and probably 3d porn in future are what will be hitting top spots - and looking at over 5 years of our statistics (my & my biz partner) biggest income come from cams.

the question is how many users want to pay those $30 a month to access one or even five websites that offer update once a week? If it's niched then ok, but if we speak about general porn then it's "harsh reality" and those sites are simply out of date.

so dating, live cams etc. probably the 3d porn in close future... don't care about tubes. i might set one or two ready just to get backlinks from a different class.
