similar web urls - copyright
 
so I just registered www.pornstarpixx.com (without knowing that ARS owns pornstarpix.com) and I plan to put up a TGP there somewhere in the future...All Im worried about though is that ARS will bust my nuts for using the name...I mean its not like a "con name" mispelling sorta scam Im trying to pull here :)

both pornpix.com and pornpixx.com exists registered by different users so I guess its okay..or ?

I think you're totally fine there. It's not a registered type name of a person, just some letters.

If I were you, I'd just get another domain, since you havent already started the new TGP.

Two reasons:

1.) People will misspell your domain and go to ARS's site.

2.) "PornStarPix" could be trademarkable by ARS, and then even though I dont think they would, ARS could try and take your domain.

speaking of that, i know of a domain that could be getting lots of hits. it's a domain that doesnt have an "s" at the end when the real site does.

what do you think i should?

1. nothing
2. email the guy and tell him to at least buy it and redirect it to his site
3. ??????

yea i agree with SomeCreep, because if your site gets too big/successful and ARS notices they might want to take it from you, and good chance they legally could |sad|

What you are talking about is cybersquatting, which is highly frowned upon to say the least. And illegal if the person has the domain trademarked.

Like SomeCreep said since it's just a tgp pick another domain and toss an FPA on that to ARS's actual site for the misspell traffic you might get. Why bother to use it if you're worried it may cause you problems.

no i dont want to buy it, what i'm getting at is i think if you own a big successfull site you probably need to buy all domains that are near what yours is. i think i'm gonna email this guy because otherwise a "cybersquatting" person might nab it.

i remember seeing something about bizarro having problems with that. sucks even worse for him because his domain name can be easily misspelled TONS of different ways

yeah but like lots of people that I've asked already has told me the domain is just a common sentence and letters. It would be worse if I were to register something like www.link-o-ramaa.com
I mean this is the same as freesex.com \ free6.com and pornpix.com \ pornpixx.com

I really want to use the domain name too since I like it :)

anyone with experience in this sort of legal issues care to comment ?

What you should notice is the number of people NOT posting in this thread... why because we are sick of saying it...

If the domain is questionable in any way.. simply DONT DO IT!

It is a complete waste of your time... !!

You just get setup and a lawyer and company with far more $$ than you comes along and takes away your domain......

Spend the 8 bucks and get a new domain!

ars has not filed a trademark

since they have not at least filed the claim before your regestration date they have no claim to the name

also with a name like that it would be very easy to show prior art
so a trademark would never standup

I wouldnt worry about it

ill-advised friend. ARS doesnt need to have a trademark filed, just show that they were using the name for their business first.

As to whether "PornStarPix" is trademarkable or not, I wouldnt know. I'd leave that up to a trademark attorney to decide.
