In my non-legal uneducated opinion, whether or not something is r@pe depends on the willing participation (or not) of the person being penetrated. Him or her being bound doesn't necessarily have anything to do with that.
As long as it's consensual I have no problems at all, and if the pic/movie is from a known and respected sponsor/provider I trust that it is.
However, given the recent developments in our industry it wouldn't surprize me at all if someone is able to dust off a forgotten law that says it's illegal to have any kind of penetration while bound. If I'm not mistaken there are still a few states that have laws against sodomy. Only in America...
