BDSM producers in the USA used to be pretty skittish about producing any BDSM with sex and/or penetration. There is very little beyond cp crap that is actually spelled out in federal law as being illegal, it all comes down to what some prosecutor may or may not think they can win an obscenity conviction on.

If you search Usenet archives at google you can find a number of threads on the subject.
This old thread on Usenet has a post from Bill Majors that explains the situation pretty well. Majors actually went to prison for selling porn, so he knows what he's talking about!

I'm sure you already know that one of the best converting BDSM sponors is US based and doesn't seem to be worried about producing really hot content featuring penetration, masturbation, and bondage, so perhaps the legal climate has become a bit safer recently.
