This isnt necessarily true - it usually is best to send the DMCA to his host, Google and his domain registrar (I believe its Directnic in this case - however the one to Google will normally take about a month to kick in if they accept it - remember that these people will only act on a DMCA if you can show copied material from your web pages

I believe they would if you show Google the number of doorway pages they have genereated, the use of the cloaked pages for Googles bot, and the misdirection of the surfers to a different page based on the keywords
