I hate, hate, HATE SPAM - but, I'd rather be saddled with dealing it on my own terms than expect the guvment to handle it for me. Draconian anti-SPAM measures are much more likely to harm legitimate bulk-emailers than they are to take down serious, hardcore spammers.
Hardcore spammers use all kinds of tricks to hide their identity. The chances of anyone even bothering to track them down, much less succeeding, are relatively small.
OTOH suppose you run a legitimate, double-opt-in email list: With many of the Anti-SPAM measures introduced, the burden of proof is on YOU. If you're legit enough to use your own email addy and not spoof your headers, YOU are the one who's going to get called to the carpet - not the cheaters who hide behind layers of protection.
Don't think it won't happen. I have a mainstream website with a teenie, tiny, totally double-opt-in mailing list. I send out newsletters about once every six months, just to remind subscribers that we're still around. Last time I sent out a newsletter, I got back a message from a totally irate subscriber, demanding to know how on God's Green Earth I'd managed to find the wherewithal to violate his sacred email box (yeah, I'm paraphrasing, but only a very little bit). I sent back a personal email reminding him he'd asked to subscribe, along with the unsubscribe link and a personal promise to unsubscribe him myself if he wasn't comfortable clicking the link. I never heard back. I unsubscribed him anyway. Asshole.
But I digress...

I hate unnecessary laws even more than I hate SPAM
