Legally if people use a design without permission and there is no defence of copyright within a period (which varies from country to country in practice though I believe international law sets it at 12 months) then you lose that copyright.... as a designer you should know that one. If I had a dollar for every site that copied my original Top-Times escort site in the 80's then I would b rich! There is also a substantial grey area as to how much of a copy something has to be to infringe copyright.
For example if somebody copied this entire BB then so long as they
did not call it GG&J (they would be guilty of 'passing off' if they did) and GG&J did not mount a proper challenge in writing within 12 months they would get away with it unless they were in the same state/country as GG&J and that state happened to have different laws. Of course none of *us* would go there would we?
If they (sex tracker) complain and I dont believe they will because their reviewers have seen the site and there are other more blatant copies out there - a site on kinghosts I saw even had exactly the same buttons - plus I am plugging sextrackers products on site; then I will change it. I plan to change it as soon as I finish the new template set to go with my VB sitebuilder anyway since I think I have a design that works better.
