if he's found in violation... and is required to turn the domain name over, can't he also be forced to show stats and P&L and be required to turn over the Profit ??
and won't the UDRP / ICANN also FINE him for blatant violation ??
once that's taken place - won't it be harder for him to get hosting and purchase domain names in the future ??
