A DMCA claim is often overkill. It's like sending a lynch mob for someone walking on your grass.
In no way do I advocate copyright theft, but an email or even cease & desist just seems a more civilized (and professional) way to do business.
DMCA claims may feel satisfying, but they affect many more people than just yourself and the one you have an issue with. It costs people a lot of time and money for being caught in the middle, when a simple note or phone call could achieve results faster.
The DMCA was designed as recourse when other methods fail. Without even attempting less severe methods, you come across as a hothead and pain in the ass to everyone along the way.
