Postal registered letter

Has anyone gotten a registered certified letter from a law frim named MSK?
You'll know what its about if you have gotten it.

I got the PDF from this attorney.

I am wondering if anyone has gotten any postal registered mail like this.

With the way things are playing out with the DOJ are you that worried?

I am not a lawyer in fact I'm a high school drop out with two years of trade school. I don't know shit about the law, but I can tune a 64 Ford.

Tell them you'll remove her name and then to go fuck themselves. What are you supposed to "compensate" her for? How did they arrive at the sum of $2,500? They'd have to prove some inconvenience on her part as the result of her name being published. Blackmail for sure.

ya Vink I cought that she is an attorney.

Lemmy, I told the attorney I wasnt paying a single penny and that I would remove her.

after talking to Rowdy today he mentioned that he beleives that the holder of the 2257 records has to be named for some time. dont know how long exactly.

Yikes!

I think I have a content disk that lists her as the custodian but I'm not using any of the photos online at this point.

A quick search on Google for her name in quotes will get you a nice list of 2257 pages. You might want to contact some of those webmasters if you're looking for others she might be after. My guess is, that's how she found your web site in the first place.

She would never win this. Never, ever. She has waited 5 years to sue you. It's one thing when a common person does not sue someone for a certain period of them. Most of them don't even know they can. But a Laywer? Any judge in the USA would have to ask why she waited so long to bring this on you. She is mentioning the 2257 law because of the current bullshit and trying to scare you or strong arm you. I would not say a word but refer her to your laywer and see if there is anything that can be done. Fact is if she is still holding any of the legel documents from when she was employeed by your company (IE copies of the stuff) and you are currently hosting any of the content, then in my opinon you are currenly up holding the law by providing her name as the COR. But I would still contact my laywer.

When I talked to this attorney Monday to seek more info. I was told he had sent these out to hundreds of people/businesses. Now if he gets 10 people to pay that 10k Cheryl will get 100k minus the attorney fees. not to shabby of a shake down scam. (Just my opinion, he might have a case I dont know).

I agree its a total scam and she prob will get some $ from it. But I always love this laywers who get other laywers to help them in cases. I also think this is going to blow up in her face. If she sent these out to that many people then its only showing how poor her communication skills are. I would think a judge would ask her if she had that many clients and was not going to be doing business with them anymore how in the world can she wait 4/5 years to take action on this. A Dr wont do a surgury on themselves, a dentest wont drill their own teeth. at least I hope they wouldnt try that...

If they were serious about sueing you, you would have been served.

I would prep to get an attorney if you do get served, but in the meantime I would simply verify your 2257 statement.

This case will be thrown out of court any way, how the hell are you suppsoed to keep up with personel changes with websites you deal with? There is no law against clerical error, and if there was she couldnt have been TOO hurt because at one time she was just fine and dandy being custodian of records. Fuck her. Fuck her in her stupid ass.
I would suggest you do send them some compensation, shit in a box and mail it to them.

Breathe easy man..It is extortion, and it's not the first time a shitbag attorney has tried to pull some shit like this

The lawyer is hoping that people will settle for 10 cents on the dollar which is considered quite good and a few companies just may do that.

It would seem that if she was the custodian of record when you purchased the material then it would be her responsibility to notify you that she was no longer the custodian. You can't be responsible for daily changes and I believe that she needs to be available for 5 years if read the regs correctly.

Sounds like they jumped the gun and should have waited at least 5 years.

My question to use is "It sounds like you have pre June 23, 2005 statements up and why haven't you updated them".

The main thing is to maybe run it past YOUR lawyer. Do NOT commincate with her or her lawyer in any way. Other then that I think it's just a minor annoyance and other then putting it in a file some where it should just be forgotten since there is nothing there other then them asking for money.

You should report this to the feds and have her and her ambulance chasing lawyer charged for fraud, extortion and possible racketeering since it's crossed state lines targeting numerous companies.

I will be looking for an attorney in my area. As my cuz is a attorney in NYC but doesnt know anything of the 2257 stuff.


One question my cuz and I couldn't find over the weekend is. There is a time limit on having the COR must be listed. Now if this person left that company in Feb 2001 does the time start then or does it start when she was first hired???? If it started at the time of her departure of that company. The 5 year statue has not ran out of her being the record holder until Feb 2006. Then that would be extortion / black mail.


So my question is: Does anyone know when exactly the time period runs out that the person be removed as the record holder???

The letter they sent crossed state lines, umm, yeah ok, the Feds will now surely get involved. And it all hinges or whether it's four of five years. Maybe you should contact the law offices of Robert Shapiro.

Just forget about it man. If they send you another letter asking where the money is, well, then perhaps persue it.

You guys don't know what site I own. I used to link indexes, and back then bandwidth was expensive. Do you know how many letters I got like that, except they were asking for bandwidth usage and legal fees ? More than 40 of them. Do you know what I did with them ? I burnt them in my fireplace and never responded.

I love how people think they have some sort of power by saying something like "after consulting with my attorney...", I usually say to them "after jerking off I've decided not to pay you."

Just be realistic. Do you really want a legal battle over something like this ? Let's say the Feds do get involved (which they won't), ask yourself, do you really want them involved, checking everything out ?

ya those are all good points.

But if the statue is 5 years after her departure (and after removing her name off as the COR, then I am now in violation of not being complient...it's a catch 22. ya follow.)

Aaahhh, I see what you are saying.

I sure hope you have the current COR.

What I would do is *keep her name on* with a note specifying that she was the COR at whatever time period she was.

I can't see the logic of her lawyer telling you to remove it because it is, after all, the truth. Just say to him: "was she not the COR at that time ?"

Problem solved.
