That the delay only protects FSC members is nonsense, IMHO. I know that's what the agreement says (and DOJ would've looked pretty silly if they hadn't thrown that clause in), but in practical terms, any defense lawyer with half a brain would have a field day arguing equal protection under the law if someone were to be prosecuted at this point in time. The DOJ will wait until some of the issues are decided in court to avoid any precedence (not in their favor) that might be set before the injunction hearing. I think that's why they agreed to deal in the first place.

Myself i would actually look at the sites that did pull content because that tells me they are paying attention and they are serious about the business, and those that didnt pull their stuff if they were illegal I would think to myself HMM if they would cheat the law why wouldn't they cheat me or my surfers sooner or later. Just for the record, the only sites I pulled over this latest flap were a few older sites promoting Topbucks that used Topbucks content. The content (with one exception) was all softcore and therefore not even subject to 2257, but the sponsor pulled the license to use that material and told all their affiliate webmasters to pull the content down, including banners. I also emailed all the relevant webmasters several days in advance.

Personally, I wouldn't want to be blacklisted merely for following a sponsor's ToS demands.

forgive me for this post which I'm sure this has been gone over many times. but I've been on vacation for the past couple of months and am totally lost as to what exactly has changed with the 2257 laws. What needs to be done to be compliant? I've tried to read the legal shit but it doesn't make sense to me. So if someone could explain it in a normal language I would greatly appreciate it. Again, sorry for this post but I really need to understand whats going on. Thanks.
