Why The DMCA Doesn't Apply To Illegal Tube Sites
I am no lawyer, but it is just my opinion, that the illegal tube site have NO protection under the DMCA. The DMCA provides protection for ISPs against lawsuits from legal liability for copyright infringement "as long as the content is removed in a reasonable amount of time".
The tubes sites define themselves as ISPs. However, I know that there is NO WAY there are so many philanthropist porn fans that want to lock down their ports on the computer for hours a day to upload video. I can understand them wanting to watch it, but waste that much time uploading? Come on. I already have information on this, but - this means that the tube sites themselves are doing 99% of the uploading. If you have a paid employee doing the uploading of material you KNOW isn't yours, doesn't the DMCA go out the window? Also, with regards to the "Premium Memberships" many of the sites now offer...taking credit card transactions to pay for stolen goods...isn't that just criminal? Again, I am no lawyer. That just makes sense to me. ![]()

It's the biggest slap in the face of them all. You are paying for "better service" and not content. It's another loophole they have jumped through.

![]() if every single webmaster send shitty** traffic there way and cause the following we should start seeing tubes close off: 1) servers capacity gets overloaded... thus causing more servers to be deployed (more cost). 2) bandwidth gets over an allowed maximum (most bigger tubes gets there bandwidth nearly for free... thus if one overflows them they would be cut by the provider) 3) techies cost goes up as there are MORE and MORE broken things to attend to... one thing is very clear... every single php/mysql system breaks if scaled over its capacity... such an attack would be more effective if the traffic can be controlled and turned onto a tube by will... all the traffic gets controlled via a dedicated server someone sponsor ... and gets returned to you (kind of like a gateway with tokens) once we see the traffic's volume is enough... send the traffic where it needs to go ![]() ** Non-US..Non-EU if a country doesn't sell on your content.. why waste your bandwidth bill? (yes i know its cheap but how many of these 3rd world countries ever buy memberships? not to often right)

Denial of service (dos) attacks are a crime, as is spamming, sending trash traffic could be considered a dos attack - not worth the risks - imo

Well, being a video editor and designer. I always feel like. Once you get the surfer to pop his load. They aren't gonna sign up for shit. The Tube sites, to me are a awesome hub for traffic, but it's trash traffic. Freeloaders that aren't gonna buy shit.
Bottom line is..if the surfer knows to hit those type of sites. They aren't gonna sign up for shit. They'll pop their load and then go back in and watch ESPN or some shit. Personally, I love to see all the tgp's and tube sites die. You get a major bulk of them to disappear and where people get back to the basics of building quality free sites and even quality movie galleries. I'm talking MPG's that have edited clips. The ones that show 3 or 4 scenes of that video, in a 20 second clip..instead of a continuance scene...you'll see much better ratios and quality traffi. People are getting so desperate for traffic nowdays, due to the pure trash that is out there. I think, we're even seeing it in even link list now days. Those Tube sites are making bank right now, based on traffic they are getting. Once some of the sponsors start seeing it not making any money off that trash traffic..they will quit advertising on them. But they will always be around..because you'll have some dumbass that is willing to spend the money to get anything to convert. But, if you look at their bottom line..what the traffic cost from Tube sites to their actual sales...I am bettin they lose money. I could be wrong..but, I doubt it. |
