If it's called theft, it is theft! Posting copyright material on a public forum of any kind without permission is a violation of copyright law. And don't give me the line that it's not registered in the copyright office – if I created it, I own the copyright. It’s just simpler to prove that I created it if I register it.
There are pre-filled forms and contracts that you can purchase in all realms of the legal world – Attorneys purchase these and modify them to meet the clients needs. You can always do the same.
But why not just ask before you use it? I’ve been both on the giving and receiving end of such requests and really appreciate it when someone asks me first. In most cases, I allow the use unless it will impact me in a negative manner. In my main-stream business, I get dozens of copyright release request every year. Most of the time, we let the customer use the copy as long as they give credits. Bottom line is that most of us appreciate the fact that someone has the integrity to acknowledge our work and are honored by the fact that they think is good enough for others to use.
And yes,
rewording a concept in your own words is usualy OK but coping and pasting someone’s code is not - and this is the only way the code can still be attached to the text.
