California considers 25% Porn Tax

California wants to put a 25% tax on all porn.

I think it has little chance of ever being enacted even if the law is passed. There is enough of a contitutional question to keep it tied up in the courts for years.

I don't think the tax would really change consumer habits significantly. The real impact would be on the bottom line of the adult DVD industry, which is already taking it on the chin. I think we'd see more companies moving production to Canada and other more porn friendly locales.

As for taxing online sales, they could only apply that to sales within CA and even then might be running afoul of federal regulations.

Typical for California, where they tend to over legislate everything.

Our local news covered this and that was one argument the news reported. They stated something to the effect that with all the internet theft it could cripple them and they would easily move out of state and more likely out of country. No country was mentioned, at least by our news station.

I have been sick, comprehension is not all there, so hopefully I did not fuck up what little I recalled from last night. There was more but I do not have an idea what was said.

If porn is taxed then is it still open to obscenity laws? I guess it could be in extreme cases but doesn't it make things legit?

Also there's not much of chance at taxing other countries.

If CA did succeed in doing that, all I can think is how sick it would be that a state full of people who embraced "tax revolt" (much to their schools & infrastructure's detriment) would think the one thing that's highly taxable is sex (-related stuff).

Never underestimate the willingness of people to vote for stupid shit that "doesn't affect them". Look at the tax increases on tobacco - and the misuse of the money generated through such taxes.

Most voters are total idiots that seldom read or understand the bills they vote for. Make it emotional and it will get passed.

Talk about idiot California voters. The voters in California have approved so many bond measures that the state is incapable of paying off those bonds. That is one reason why California has a lower bond rating which is a small measure of their liquidity problems. Also voters have approved guaranteed funding percentages for education which really limits budget flexibility and eliminating waste in the educational system. The California initiative system of getting voter signatures for a proposition to be on the ballot does create some idiotic results but it also led to Proposition 13 in the late 70's which severly limited property taxes. If that measure was never passed, California would have had now the highest property tax rates in the country. Also voters in California tried to legalize marijuana until the Feds stepped in and established term limits for the idiot politicians in the state of California. Idiot voters or not, at least you have the chance to make some changes. I would like to see a national initiative system, especially votes of confidence like you have in a parlimentary system.

A lot of voters have a vested interest in increasing taxes. One of the biggest problems IMOA.
