Read the PDF listed there and ya will see how hard the DOJ is going to come back on FSC at the hearing. i got thru first 12 pages of 35 and damn thats some hard reading.

While FSC attorney Jeffrey Douglas told XBiz that he could not reveal details, he said there will be an announcement tomorrow at 1:30 p.m., and it will be “big news and good news.”

That cool thing to see.

While this does sound like good news, I can't help but be somewhat disturbed by the repeated implication that only FSC members will be covered. These guys are lawyers, they know better.

The DoJ must not have a lot of faith in it's ability to push this law through if they are bending so early in it's campaign.

I don't want to discourage anyone from joining the FSC. I'm sure they have great plans, and any day now they'll start seriously lobbying for this industry so that bullshit regulations like this never see the light of day.

I'm sure that any day now, the FSC will have a PR department in place, so that damaging media reports (like the AP article that basically made us all out to be scoundrels who can't be bothered to check ids) will be quickly rebutted in the national press. And we won't have to wait for the EFF and Planet Out to insert well-considered articles.

They could have had my $50 bucks, in a heartbeat. Fifty bucks times thousands of webmasters could equal enough seed money to actually do something worthwhile.

$300 per website? Smells like desperation to me. I spent most of my life before the adult biz working in non-profit orgs. I know a money-grab when I see one.

Yeah People are naive sometimes To me it sounds like a desparate last minute pitch to snag in some members Big News Good News Maybe it should Be We have No Idea | We really have no Idea.

Maybe im wrong but I dont think The DOJ is going to broker any kind of deal just for a restraining order.

I agree. Lets all keep in mind thats a big government place and like any other large office will have people who agree with it's direction and thos who don't. I can bet durring their meetings the word "constiution" had been thrown around in allot of heated talk. I would go so far as to say maybe 15% of the legal team working there now has issues with this but dont have the power other then their mouth to fix this. But hey having them there is a good thing. Helps keep the powers that be somewhat grounded. Well at least I know I was the screamer where I worked and that did help in leaving the issues on my bosses minds when they went home.

Here's how the deal only protects FSC members:

While the FSC has filed for a TRO (temporary restraining order), they have struck a deal with the Justice Dept for FSC members. This is a 'good faith' agreement with the Justice Department to not go after FSC members until after the court battle ensues (something AVN seems to think could take several months.)

Everyone else in the business is fair game for the DOJ. I wonder if the FSC is realy going to keep pursuing the TRO now that the deal is done.

For those of you that signed up, nice move. As for me, I'll wait until they win or fall on their face before I join. I still have yet to see their worth or mettle. So I'll change biz models until this shakes out. Everything about how they have handled this doesn't pass my 'smell' test.

For non-members of the FSC who haven't pulled their sites or redid their 2257 info...buckle up. You just became the low hanging fruit.

There arguements supporting the record keeping burden on seconday producers are certainly better than what the DOJ presented in sundance v reno.

It will be interesting to see how the courts decide this.
