Question Warning pages on pay sites

Recently had a discussion with a friend who's developing a paysite, which has semi-hardcore images on the first page of the tour. When I suggested that he should include a warning page he pointed out that a lot of pay sites no longer use them: twistys.com, for example, and free sites like sextube.com and many others go directly to the hard stuff.

I was always under the impression that if you used penetration images on tour page one, there should be a warning page, but I've been looking around and see that it's no longer de rigueur.

What's the standard? Are warning pages now just a 'courtesy thing' with nothing to do with possible legal repurcussions? Or is this something my friend should be taking up with a lawyer?

Comments appreciated, particularly from those of you who run paysites.

I think paysites feel similar sales pressure like TGPs, tube sites and blogs. As long as they label their sites properly with RTA or IRCA I think it would be considered acceptable because it can be assumed that responsible parents install content filtering software.

To my best knowledge there are various countries that do have laws about adult content warning pages and real age verification in Europe, but the US is lagging any laws. Sites that abuse this no-warning-page policy will be more or less responsible for a very strict law to be passed once lawmakers are less busy imho.

I remember a long time ago one of the big TGPs said something like you can link directly to the content from his site 'cause the surfers already know about porn coming from his site.

A lot of sites will have a warning page on the root, but all incoming links from affilitates, FHGs, trades, etc. will go directly to a tour/content/TGP page, with hardcore.

Thanks for input. So I take it there's no real rules if you're going for a mainly US market, but filtering labels are a good idea.

Well, I think there is a rule if you are going for mainly US surfers, if you live in the US and are hosted within the US. Id say you'd be safe with having a warning page with non HC content on the top level root and have all the FHG's, affiliate links, etc point to the actual tour

Im on the side of what Tickler said. I think its our responsibility to do as much as we can to educate and make aware visitors of our sites what they are about to view.

So my roots have warnings, my affiliate tours do not.

we do it just to be responsible, to both parents and also just to serve as a warning. its also a good place to add links that are not as important to us. however our affiliate tours miss the entrance page out and og straight to the harder stuff....

we are in the UK and not really that concerned by 2257 either, however we do comply just to be on the safe side and also as our affiliates in the US need us to be compliant.

Warning pages can be a good place to develop an SEO strategy. As far as necessity consult an attorney of course. But labeling is definitely a good idea in general.

I use a non nude warning page on http://www.ivyblack.com

Covers us in any case. I feel like it allows us to link from social net sites etc without having to really worry about getting deleted.

Then affiliates can just link to /tour and everyone's cool.

Warning pages are great for review site backlinks. But all affiliate traffic goes straight to the tour.

I think the warning page is an excellent practice. Responsible parents will have the filtering software on, yes, but use it as a teaser like a lot of the top-rated paysites do. Done right, a warning page is not only excellent SEO fodder, but a great place to tease your visitors. Most of the sponsor programs I work with offer me the option of sending my traffic where I want. As freesites are often more of a mini-tour, visitors can be sent to the join page. The smart ones still do warning pages.
