Just a 2257 FYI.
 
To stop the madness, I have contacted an Albany NY Bill of Rights Law Firm to give us their opinion on 2257. I have spoken to them on the phone, thus, http://www.javes.com

But, I have asked for an opinion that I can post for all to see. I have not been given a price yet so I may have my hand out :) We need someone with nothing to gain but justice giving us information. I would never single out an online attorney but, we really need an opinion with nothing to gain from our fears. Or should I say, your fears :)

And, I think it may be a resonable price. If it is, I will cover it on my own. But if it is a crazy price...I will setup a place for donations. But, no matter what, everyone will be able to read it.

I agree...I've seen so many money grabs, fear tactics, and misinformation that this would be like a breath of fresh air. Post a donate link, even if it isn't that much, I don't think you should foot the bill for all of us...I'll happily donate what I can :D

Jim- what does www.javes.com represent? If they are saying that the galleries on display are not compliant with 2257 content then I think some of those said to be non-compliant would not agree with the interpretation by the FSC.

I have an appointment Monday with the main firm partner. He has read the ruling and is very interested. We are going to talk money on Monday. I really want to pay for this myself but I am not a rich man. I will keep you guys updated.

Just as an fyi...and remember these guys deal with internet law and bill of rights law every day. But, my mentioning it to them was the first they heard of it.

Whatever it costs, the piece of mind will be worth it. I know the firms opinion already but I am not going to say anything. I am going to let them tell you. This law firm as I said strictly deals with the bill of rights and amendments. Today, I will have the final price. I most likely will cover the cost for everyone. I really am not one to beg for money from webmasters.

But, around Christmas time, I will be begging for my wife's Toys for Tots charity. I will spell it all out for everyone when the time comes. I remember growing up as an only child and the tree was always overflowing with gifts for me. I would go to school and ask my best friend, what did you get. And he would tell me, a new shirt. My wife was the same way...very little at Christmas time. We both decided fuck that... Children deserve a decent Christmas. Anyway, I digress. The time is not here yet.

I am back...The lawyer told me what he thought about 2257 but I won't get into real details as to who and why until I get his briefing. I will be paying for it myself. My tree money might as well do some good for the business.

The short version is...depending on who they go after, this lawyer doesn't think it will make it past the first test case. Unless they go after a content provider without the paperwork. But, I really don't think too many content providers don't have the paperwork.

He laughed when he saw javes.com and said, "good for you". :)

What does 'content provider' actually mean these days ? If I link a FHG with a text link am I a 'content provider' ?

I just read that someone talked to the DOJ on the phone and they said if you text link a gallery/site you are a 'secondary producer', can that be true ?

Sounds like a logical guy...logically these regs cannot stand.
