I have been accused with gallery theft by a guy who is using the same
paysite logo and colors (Cumshot Circus from PimpRoll) and DIFFERENT
content. He is threatening me with a lawyer and has contacted my hosting provider.

What would you do about it?

Ok, let me see if I read this right.

You are using graphics you took from “Cumshot Circus's” site to promote “Cumshot Circus” correct?

And this guy has threatened to sue you for him doing the same correct?

Well, I would make sure that “Cumshot Circus” approves of what you did and if they do I would tell them what this other guy is doing/saying and go from there.

I'd contact Pimproll right away and get in front of this. Looks like you've got an asshole with too much time on his hands and no understanding of the law. Get authorization (in an email) for what you're doing, then forward the email to the proper person at your host. Unless you're using something HE owns the copyright on, he has no standing to challenge anything.

Content someone at Pimproll by ICQ or phone (email might take too long) and tell them this. That you are using some graphics from the tour itself and some other affiliate is calling you a theif because he did too acting as if those graphics belong to him.

Get them to email you an ok to use the graphics and forward it to your host and that idiot.

I wouldnt do anything untill I got a letter from a lawyer.

which isnt gonna happen because he doesnt own those graphics

ya see this a lot people making claims to content or other stuff that they dont own nor do they represent the owners

if i see someone stealing a car that belongs to someone else it doesnt give me the right to sue the car theif

let me assure you that you have to do nothing, I received an email fro the accuser this morning and looked at the two galleries, I then replied to him saying that you have done nothing wrong, and that I saw no similarities between the two galleries except for the header, and we give you theheader, every single webmaster can download it from PimpRoll.com

Furthermore I asked him what exactly he thought you were copying, but he has not responded.

To re-iterate, you've done nothing wrong, and should ignore the complaint, I represent PimpRoll and will deal with the accusing webmaster myself!

I would hunt him down and inject maggots in to his anus with a turkey baster. But I've never been known to be a pro at conflict resolution.

My biggest concern would be assuring your host that the accuser is a complete nut job making libelous attacks in an attempt to eliminate his competition. It wouldn't hurt if you sent your host the link to this thread. I'd leave out the part with the maggots and the turkey baster though.

I have contacted my host right after receiving the e-mail from the accuser. They are also aware of this thread :)

I have been building and submitting galleries for the last four years, and this is the first time someone would accuse me of stealing. The most disturbing fact is that this is not someone new to the business.

Thank you all for replaying to my post , hopefully this will bring my out of the lurking mode for some time :)

well call me stupid but i think the guy is nuts, he dont have a case you both use pimproll paysite stuff, which is owned by pimproll and the guy is going after you because you use the same stuff..............oh you gotta love this bizz, some people are not mend to be in this bizz|violin|
