Great, now I'm losing webmasters over Acacia
I sent out a mass email to the webmasters using my program announcing our new hosted galleries and one of them writes back, "Please remove me from your program. I don't want you selling my info to Acacia!!"
This is bullshit! I'm so pissed at the program whoever started all this crap and giving out affiliate information to Acacia because now small programs like myself are becoming affected by this! |pissed| P.S. We don't sell ANYONE'S info to Acacia. Not for a million dollars. I hate those guys now that this is affecting ME! |pissed| |
You have one new one I just signed up |bananna| |roses| |bananna|

this is really awful, I wonder how many other people Acacia are scaring off from affiliates by saying that if you're associated you'll get done.
but like DD said you don't need guys like this. If acacia really can get someone for linking to movies then they'd be after google, yahoo etc. The real big $'s regards garv |
Amazing is'nt it? One piece of shit trash bag company sells a webmaster list and now the assumption from some ass clown is that everyone does.... Pathetic you dont need that idiot, he'll be working at IHOP before you know it because he never recieved mail with the new great tools you or any other program released in order for his dumb ass to make money.

The problem is that in reality, it appears that two or three companies have provided, knowingly or not, webmaster info to Acacia.
There is a possiblity that Acacia had one of those badge swiper things in Florida, and got a lot of info on people that way (which is a semi-valid way of making webmaster contact, just not for legal service purposes!). It would also appear that a content company and a webmaster program also provided info. One thing for sure, January show, if there is a 'scannable" code on my badge, it will get disabled before I go on the show floor, or the badge will stay in my pocket out of site. Considering the fluid nature of the situation right now, I would not want to be a program owner on either side of things. If you pay Acacia now, you can lose webmasters. If you don't you could lose webmasters as well if you provide linkable content, as Acacia appears to be holding the freesite webmaster responsible for using this content without paying the patent. Which means webmasters may drop from the programs to avoid hassle. it sucks all around, I hope someone gets a restraining order on these morons (it looks like restraint of trade to me!) Alex |
Does Acacia have a web site?

What I personally feel about Acacia's MO
is that their current tactic is going to backfire on them big time. Spike and company have filed a suit agaist them as well charging that what they are doing as unfair business practice.
Acacia said "The big bad webmasters are telling others to boycott businesses that sign licenses with us (untrue) or threatening them(also untrue) or giving legal advice on webmasters boards (untrue yet again)." Yet their current tactic is exactly what they say the industry is doing...........threatening webmasters, but it is ok when they do it. The biggest pile of dogshit this company has done was to send out packets without investigating to whom they were sending them to. When a huge number of people, who have not one bit of streaming media on their site, nor link to any, get these notices. It reeks of extortion. And even though individually these webmasters probably do not have the means in which to go after Acacia, I would be willing to bet if any were within a hundred miles of a hearing they would jump at the chance to testify against them. Someone tell me if I am wrong, is this Acacia 'patern' Content provider creates a streaming sex show (Acacia threatens) Webmaster Puchases streaming sex show (Acacia threatens) Affiliate links to webmaster (Acacia threatens) Some one else links to affiliate (Acacia threatens) Whats next??? Surfer visits site that links to affiliate that links to webmaster that link to streaming sex show and Acacia subpeonas the server stats and threatens the surfer? ya know, I once thought about visiting a site that links to the site that links to the affiliate (wooden ball rolls down a track like 'Minority Report' and Acacia sends me a packet.) I am glad Acacia is so unfocused, shows they are weak. Triple dipping works directly against the average Americans sence of fairness, and we may be a lot of things in this country, but we do not like anything that is unfair, even when it happens to those we dont personally know. To the Acacia lawyers Business is business, but you are fucking up. & your far to ivy league to realize it. as for the wannabe who says take me off your list BS, tell him to hit the books, he has to have a mid terms coming up soon. spaz |
Man with all the AVS hassles and now Acacia it may be time to go back to free sites and downloads... Personally I thought they were kinda crazy for sending me a letter and I had to just laugh at it, but losing webmasters over it is nothing to laugh about...
Seriously though if this guy is that scared of a bogus letter then he might be in the wrong biz anywho... jmo |
I think Acacia doesn't have the money to go after big companies like Yahoo, CNN, MSNBC and other huge sites that provide streaming media content on a daily basis so they're trying to go after us little guys first, make a quick buck, and then maybe attempt bigger feats.
It just shows how ludicrious of a case that they really have. |
Just a thought here - with No Actual legal advice behind it -
What if All US webmasters that have recieved the Acacia letters counter sued in small claims court in their Home Counties? (ie 1,000+ webmasters in 1,000+ different counties) Yes, damage limits may be limited to $500.00-$1000.00 but I'm guessing it sure would be a mess for their lawyers to try and figure out. Just a thought - replies welcomed |
So let me ask a question of those of you that are sponsors... are any of you paying the licence fee to Acacia? Just wondering.

Maybe I'm thinking on the wrong track but doesn't the series of patents cover the transmission/encryption of the videos? Wouldn't this mean that MS QT and Real are the top 3 violators of these patents - or do they have their own that conflict with the ones being touted by this company?

i'm seriously considering cancelling Vegas in Jan and using the money i'd of spent to send to IMPAI. because if we don't stop this crap NOW there might not be a reason to go to Vegas next year.
