Ok as I stated I called Acacia on Monday Oct 27th to get some info.

I got a call back today and what was told to me was.

I will use Hustler as the example again.

If hustler pays (which they have) for the license fee we can keep linking to that sponsor program without any worries.

The sponsors that don't pay we (webmasters) have to pay.......It doesn't matter if you view stream from windows media player or real one player or quick time player. if the sponsor has paid you are clear and can still use that sponsor.

If you purchase any video for your site and display that on your site you will need to buy this license.

Also if you produce your own video and display it at your own site you will need to pay to display your exclusive video.


I asked acacia if there was a master list of what sponsors have paid and or havent paid. They cant give that info out. But I was told the best bet was to email the sponsors to see.


This info came straight from the source.....Hope this helps, It has helped me to better understand.

So if we recieved a letter from Acacia... and we are using one of the sponsors that are licenced... do we have to contact Acacia (if we recieved a letter from them) and tell them this in order to keep us off the hook??

Just wondering what you had to do when you spoke with them...

This is the crux of the matter and how we find out who has and who has not signed. I think they are boasting that 47 companies have signed up and we do not have a list of them.

Well if you have a letter, email your sponsor/content provider and ask him if you are liable for the license, in fact even get your lawyer to do it. Then if your sonsor lies, he is in the shit.

We will soon find out who has done the dirty on us. And share the info with us.

This is my first post on this subject and most likely my last. I assume that you all will take this constructively.

1. Take this issue out of the public. Don't you know that Acacia know that they have the small webmasters (submitters) scared? I assume that there attorneys can read and believe me they have someone reading this board and others daily.
2. Unite. You got an organization formed, IMPAI. Get mutual attorneys and send all of the mass mail letters to them. Let a professional handle it. How many submitters have the funds for their own attorneys? Acacia figures not many and they are probably right.
3. Break out the checkbook or cc and donate. To fight this it is going to cost money and make some attorneys rich. United together the industry can afford to fight.

It is my opinion and everyone has one.

those are soem good points Chop but one thing about it is you say to join together but in order for people to unite under one lawyer we would have to form groups according to states right? So basically all of us from Tennessee would form a group with one lawyer who could practice in this state representing us and all of you from Mississippi would have to get a lawyer from that state. There are lawyers that can work in multiple state like here in Memphis becasue it is so close to Arkansas and Mississippi that they get liscensed for the surrounding states. I am correct in what I am saying and making some sense right??

Wicked, think you are wrong. Any attorney worth his pay would have this action moved to federal court. And think about it, does Mississippi have copyright laws - half of our legislatures can't even spell Ole Miss? If Acacia does have a copyright infringement, and they probably don't, it is a federal matter. Now as far as Paul over there across the pond, I don't know how they can even touch him without going thru association of international council. That is way over this redneck's head.

Acacia is whopping the adult community’s butt right now. They are not doing it legally. They are doing it psychologically. Ever phone call that they receive from a submitter gives them a big laugh. When Acacia's attorney read where jumping out of a sponsor, he probably climaxed.

My point is get a leader and speak with one voice. The voice has to be paid. When I made my contribution to IMPAI, I assumed that they were the leader and that the money was going to be used to fight this thing. Speaking of money - Greenguy, Jim, and the Extreme guys were very generous in their contribution, but it really did suck that the contribution given in the name of the GG&J webmasters was as small as it was. I bet that less than 1% of the webmasters here made a contribution. I further will bet that less than 10% of the folks that have spend their time in posting to a tread about Acacia, made a contribution.

Sorry about ranting but all of this whimming is getting old. It is time to put up or shut up. The time is here; tomorrow will be to late.

Now as the sisters sang would you brothers pass the collection plate and I'll say the final amen and we'll go eat that fried chicken.

I wasnt completly sure about the court situation so thank you for clearing that up. Isnt there a Lawyer who will represent the adult industry thats really good, I remember reading something about him..that would be a place to start.

Havn't seen a thing about the the webmasters as a group having one, but I have not been looking either. If he is good, he will be expensive. Copyright law is very speicalized and extrmely complexed.

So is there an attorney hired for a group and who makes up the group? If so, join the group and let the attorney handle all of this stuff.

A submitter dealing with a good cc attorney, would be like Chop trying to tell GreenGuy how to run a link list.
