Another 2257 Question
 
In light of the 2257 regs, a number of sponsors seem to be concerned about the content being used by their affiliates to promote their sites. I can understand if the content is sponsor provided, but why do they care what content I use as a gallery maker to promote their sites if it is not their content?

That's right up there with sponsors that say they will cancel your accounts if you don't remove hardcore banners or content. Why apply it to foreign WMs?

ardentgent - it sounds like that sponsor is worried about the DOJ coming after them if the affiliate is using non-compliant content - sorta like when a sponsor has a "no email spamming" policy, as technically they are not breaking the law, but their affiliates would be by spamming & thus, they might be dragged into any spammers case.

That's what I thought. Don't you think it's kinda silly? If they are in compliance why should they really care?

But accepting traffic from non-compliant sites could be looked at the same way that accepting traffic from email spammers is.

They care because they could still end up having to defend themselves in court, an expense they'd rather avoid.

I guess they could end up in court if my gallery with explicit content leads the feds to them. But, If I am using content in violation of 2257 that is not directly their problem.

But if you're using that content to promote their program the Feds could very well decide that they're an accomplice, stranger things have happened, just ask some of the sponsors who have the FCC up their asses about affiliates using spam email.

ardentgent - I tend to agree with you on this one, the sponsor has no control over your domain or the content on it so they should not be concerned with whether you are 2257 compliant.

But most are putting in a load of extra clauses just to cover their own butts.
