Supreme Court of Canada says swingers clubs with group sex, swapping are legal

OTTAWA (CP) - The Supreme Court of Canada says Canadian standards will tolerate sex clubs featuring group sex and partner swapping amid spectators.

Ruling on two similar Montreal cases that went in opposite directions in the provincial appeals court, the justices say the test for indecency is the harm it causes, not simply community standards.

The 7-2 decision says group sex or partner swapping in a private club doesn't cause harm to society and shouldn't be criminal.

The cases involve two swingers clubs in Montreal that allowed sex acts, including swapping.

Just as importantly, it sets the bar pretty high on the idea of indecency in all forms... including what could potentially happen inside a strip club, or what might appear on a website. Community standards as a concept is pretty dead in Canada, i guess :)

Criminal law in Canada is a federal responsibility so the ruling is country wide and can only be changed by an act of the House of Commons. Our provinces, unlike your states, can't decided what criminal activity should be.

The socialist NDP and the Bloc party from Quebec have about 25% of the seats in Parliament and will certainly have more after our January elections. Add a number of Liberals to the mix and there is virtually no chance of a new law being enacted.

Our abortion law was stuck down by the Supremes more than 20 years ago and no law was ever made to replace it.

Anyone know where the club is and have directions? :D

I didn't realise swing clubs were illegal in Canada though i kind of guessed they may be in the states. They've been legal in the UK for a good while now. Two are located within a few miles of where i used to live. I guess once you get past the rain life in the UK isn't so bad after all :D

Off premises clubs were alway legal. You could meet someone at a club but you could not have sex there. Now you can go to a club, paid an admission fee and have sex at the club. The participants cannot, however, be "professionals" just your ordinary swingers.

The real big change to this is that the Supreme Court In its 7-2 decision, redefined indecency to use harm, rather than community standards, as the key yardstick. That certainly could open a proverbial "kettle of fish".

In the U.S. it depends on the community. There are 'legal' lifestyle clubs here where you can have sex, but there is always that feeling that the cops may raid you at any time becasue some tight-ass decided they couldn't stand the idea of consulting adults fucking.

Can you imagine a cop |club| tapping you on the shoulder in the middle of a club during a raid when your on the short strokes!!! |shocking| thats got to put you off your stride lmfao :D
