Do sponsors need Custodian Of Records IN the US?
Coming across some small but nice sponsors located in Europe and Asia.
Their Custodian Of Records is outside the USA. Even if they are compliant with documents, don't they need to have a set of records based in the United States to actually be compliant? |
I think it'd depend on where their servers were located. If they & the servers are outside of the US, then I doubt they'd need to follow US laws.

I wasn't concerned about them as much as me potentially promoting them. :)

Read the law - it says "records at the place of business".
It all depends on where the company is registered. ISPs are basically immune, I don't think much has ever been done based on location of servers alone. Alex |
Actually, I shoud have added that I wanted to use their content to promote their sites which is what prompted me to post this thread.
http://www.avn.com/imagearchive/10/68/50/1068502257.pdf 75.4 doesn't state the records must be kept within the United States- from the couple paragrpahs I read. Though, it would seem implied to make the records available to the DOJ they'd (the records) need to be within the US, no? |
