Jay - most of these people (free site submitters) dont make $5000 in a year that it would take for the retainer to be able to talk to these lawyers - so I think most of them are playing it safe by just 404/302ing the sites until a consensus has been played out - I happen to agree that it really doesnt apply but Im not going to give out legal advice about it
Im also making it so that my free sites and galleries come up 302/404 but with the option to put them right back online with the flick of a switch
