I don't know how this could be since obscenity is defined locally and really what is obscene cannot be known until after a court case. Of course this is one problem with obscenity laws in the first place, that one cannot know before hand whether one is violating them or not.

Secondly, obscenity laws, as they relate to private enjoyment at home, transfer through the mail, and transfer over the internet have been found to be unconstitutional by a federal judge in a recent court case - extreme associates v reno.

I believe that the DOJ is going to appeal that decision.
