Search Word Thief

A friend pass this on to me a week or so ago.

http://www.allfreepics.info/30921.html

Not our content, Not being used to promote us in any way, but our name and at the bottom a lot of our text that we have written and other have written about us, and I found it on more then one “page”. I imagine he is also doing the same to a lot of other people as well.

I wrote the email provided at the bottom this email

I would like you to either remove all reference to KatVixen on your site/sites or sign up to our affiliate program and link to our site directly. This is our trademark and we will do what it takes to protect it.

And today I received this as a reply

***
Good day,
i've done tm search on uspto.gov and i found nothing Kat Vixen related,
in what country do you have trademarked Kat Vixen?
***

So I gave this guy a chance, I have forwarded this all to my attorney and he will see what, if anything we can do. Of course the “whois” is all bogus so I will be reporting this to ICANN as well and I will be looking over his “sites” and if I find any sponsors I will be contacting them as well.

Realistically, if you don't have a trademark, you don't exactly have much of a legal leg to stand on. However, you might want to contact his sponsor (TCG) and mention that he is going this to attempt to steal traffic looking for Kat Vixen, and see what they think.

You might get much more satisfaction out of removing the guy's money rather than chasing him around with a lawyer stick, especially considering you would have to find a lawyer in HIS jurisdiction to really get anything done.

You might also want to take the steps to get the name Kat Vixen registered in some manner so that you have an actual legal stick to use next time this comes up.

There are groups of people out there using .info domains in the same manner for almost every site on the net, your situation is not unique. I report anywhere from 10 to 50 pages per week to Google for the same sort of offence.
