hosting does geography matter?

Hi does anybody know the deal on server location, I work for a media company that doesn't want to host their adult content in the UK anymore, they want to move it to Holland where the law is more relaxed. I got in contact with a Dutch hosting company and found their data center is in Malaysia!!
Surly the law of the country where the server resides determines whats legal on a server and what isn't. Not the law in country where the hosting company is?
Anyway our content is perfectly legal its just getting harder to sell xxx online unless you are a licensed sex shop etc... Or have your operation abroad!!

Ps. Any links to info on laws in other countries on this issue, or good hosting companies in countries that are more relaxed about content would be appreciated.

There is a lot of issues to think about when looking for adult hosting... location is one, adult acceptance is another, and of course, laws. Datacenters is important to know as well because most people see a hosting provider in one place but don't realize that company's datacenters could be in another country. What it comes down to is this...and although I am not a lawyer...wherever the content is stored or served, is where the laws should apply. So if your site is hosted in a datacenter that is located in another country, that country's laws should apply because its in their country. In some cases, you may not be fully protected if this is the case.

I would search for hosts, but ask them where their servers are. Another option would be to consult a lawyer.

First, I wouldn't suggest choosing any host which has a Russian translation of its site available.

Secondly, if your company intends on serving web pages to U.S. citizens, it doesn't matter where your host is physically located. The FBI will fly there and take your server home with them.

hmm, I have very recently heard that the act of uploading material is the very same as act as publishing material, so in that instance it wont matter if your data center is on the moon.

That is to say of course I understand the location of the data center is the key to this problem....

I think you are going to have more of an issue of where the company is based. If your company is based in the UK then I think you are going to have to stick to both UK laws and the laws where your servers are along with the laws of where your processing company is based. This is such a grey aera, getting a good INTERNATIONAL laywer who has expericence in adult internet matters would be the best way to go. If for nothing pay them for the advice. Even if the person charged you $1000 US it could save you some major headaches down the line.

dutch hosting is also expensieve, reason why i host my stuff outiside holland, and the only reason why some company wanna host in holland is because , yep we alow ani**al porn and the age for having sex is muchhhhhhhhhhhh lower then anywhere else, means if you have 16 yar old ones on your sites you wont get punished in holland for it, my thinking: if a non holland company wanna host their stuff at a host in holland...then there is something sneaky there... and i am a dutchie, yep holland sucks big time
