Man Whose Porn Site Ran War Dead Photos Gets 5 Years Probation

BARTOW, Fla. -- A man who ran a pornographic Web site that included grisly photographs of war dead taken by U.S. troops was sentenced Friday to five years probation, his attorney said.

Chris Wilson, 28, pleaded no contest in January to five misdemeanor charges of possession of obscene materials, and the state dismissed 296 other similar charges.

Wilson's Web site gave soldiers free access to pornography in exchange for posting pictures from the Iraq and Afghanistan wars. Polk County sheriff's officials said Wilson's arrest in October stemmed from the site's sexually explicit content, not the pictures of war dead.

The plea agreement does not prohibit Wilson from using the content of his former site, although ownership of the Web address was transferred to the sheriff's office, defense attorney Larry Walters said.

"He agreed to stay out of the adult Web site business for the term of his probation," Walters said.

Instead, Wilson will create a new Web site focusing on obscenity prosecutions and First Amendment issues, Walters said.

Wilson, a former Eagle Lake police officer, also agreed to pay investigative costs, Walters said.

Though the Web site launched a Pentagon investigation into how war zone photos of charred and dismembered bodies described as victims of U.S. attacks could have surfaced, military investigators did not pursue criminal charges against Wilson.

I looked at the war pics that he was running. None of them looked like porn to me or at least I didn't get turned on by any of them.

That was more the issue even in an sexually uptight bible belt county like Polk. It was the graphic pictures of mutilated corpses that really did him in. Notice he was convicted of obscene pics not pornographic.

I am sure he could have won this

investigative costs, 5 years probation, barred from the buisness Plus the time he already spent in jail

Yup bad results, but then again there are many people in jail for crimes they did not commit where they pled out. Sometimes when they threaten with overwhelming penalties people take the easy way out an admit to things they did not do rather then risk the man putting them away forever

when you think about it

his site was a board mostly user posted pictures

I think he could have easily argued that

he didn't feel he had any right to censure those users
who came from other states and countrys

or that he believed that he shouldn't impede the free speech rights of those users

also that since it is a 24/7 site there is no way he could police it 24/7

he has to sleep and eat

those users posting those pics where outside the jurisdiction of that FL county

and the pics and the entire website was outside this jurisdiction of that FL County

The problem was the 296 charges against him and being in the state of Florida. Even if he had unlimited funds he would have been in court fighting for years and I'm sure he had more then just the Polk County boys digging into his shit.

Sooner or later they would have nailed him on something or simply kept in court for years to come.
