Acacia, more news
A holding company that has a stack of streaming media patents briefly shut down a network of pornography Web sites over the weekend in an ominous sign for mainstream providers of streaming Web content.
The company, Acacia Research, on Friday said it had used a court injunction to persuade a Web hosting provider to unplug the Go Entertainment network of 42 "adult entertainment" sites. http://news.com.com/2100-1025_3-5081177.html We need to stand together now. www.impai.org |

Well pretty much makes sense, you at least need to respond to the contact efforts made by Acacia, and trust me Im not sticking up for them, Im just saying that Go Entertainment should have showed up to the dance at least.
This should be on the main board, not just Chit Chat

Not showing up in court, or at least answering the summons is just not very good business. They ain't gonna go away, and default judgements go into effect allow faster than anything!
There seems to be a trend of companies signing up with Acacia for a couple of reasons: 1 - they look to be forgiving the past, the licenses appear to be for the future only. 2 - the license agreements appear to have a negation clause, which says "if the patent is proven invalid or not applicable, then the funds will be returned". Basically, companies are saving themselves expenses, removing risk, and allowing other people to fight the legal battle. Alex |

RawAlex: Everything that we have seen from Acacia indicates otherwise on giving back anything if their patents are proven invalid. Anyone who saw the material they sent out would tell you the same. Acacia exec Robert Berman himself said in an interview with D$ that they would do not do that and gave his reasoning.
I know that has been claimed, but I would like to see it in print with Acacia signed off on it. Companies mainly settle, imo, for the following: 1. Don't have or don't want to spend the cash to defend it 2. Poor representation 3. Don't want to go through discovery 4. Forced by injunctions because they did not deal with it appropriately in the first place No one settles because they agree with the patents. That is universal as far as I can tell. |

Just to clarify...
The IMPA can only help in ways that help the general community and not directly for the benefit of a few individuals. So the IMPA can help with some research and provide informational resources, but the IMPA cannot pay for the defense. That enormous burden is carried by each of the companies being sued by Acacia. Do you think Scores Cash will be reopened?
It doesn't look good to me at all, the fact they didn't bother to respond or to show up in court turn my red lights on I guess I should remove their banners A.S.A.P at least until we get a clearer picture of what awaits them. Anyone else? |

They are reopened and the latest to sign a license... not because they agree with the patent claims but because they made the mistake of not taking it seriously until an injunction was enforced against them.
