hosting does geography matter?

Hi does anybody know the deal on server location, I work for a media company that doesn't want to host their adult content in the UK anymore, they want to move it to Holland where the law is more relaxed. I got in contact with a Dutch hosting company and found their data center is in Malaysia!!
Surly the law of the country where the server resides determines whats legal on a server and what isn't. Not the law in country where the hosting company is?
Anyway our content is perfectly legal its just getting harder to sell xxx online unless you are a licensed sex shop etc... Or have your operation abroad!!

Ps. Any links to info on laws in other countries on this issue, or good hosting companies in countries that are more relaxed about content would be appreciated.
