The lawyer is hoping that people will settle for 10 cents on the dollar which is considered quite good and a few companies just may do that.

It would seem that if she was the custodian of record when you purchased the material then it would be her responsibility to notify you that she was no longer the custodian. You can't be responsible for daily changes and I believe that she needs to be available for 5 years if read the regs correctly.

Sounds like they jumped the gun and should have waited at least 5 years.

My question to use is "It sounds like you have pre June 23, 2005 statements up and why haven't you updated them".

I didnt know it was out of date, and I am looking everything over (sponsor and content wise to get things all current). As you said "You can't be responsible for daily changes."
