If you were using the RSS feed strictly for all of the content on your site, then probably so. If, on the other hand, you wrap a very high percentage of your own content around the feed, then I think your safe. But then again, I haven't heard any of those with RSS aggregators complaining SE problems.
As far as less than ethical webmasters
...I don't think you run any greater risk than you do simply by putting a site on the WWW.
