2257 and Canadian webmasters

Does anyone have any information or links to Canadian law sites/articles/information which can explain how current US 2257 and the new ammendments will affect the Canadian webmaster who hosts in the US? Canadian webmasters who don't host in the US?

What should we be aware of?

Basically, if you have any business holdings in the US, host in the US or get CHECKS from the US, you must comply. (That's my understanding).

Maybe they won't 'come get you', but they can sure seize and/or freeze anything you have here if they choose to do so.

In addition, if it were to play out to the max and you ended up with arrest warrants in the US, then that would pretty much make it a tough decision whether to come visit Aunt Millie or even fly over US soil or water.

It's not that hard to comply. I look forward to it. I have software in place and since I already own all of my content with model IDs, anmd I have pages with lists of my perm galleries it's no big step (for my wife, LOL) to get them into a database.

This'll also make it a LOT easier for me to find what I'm looking for when I need a set for something rather than looking thru a hundred CDs for it

Adult Traffic: The lawyers are NOT 100% in agreement on this one. One of the consideration is the canadian privacy laws, which make it pretty much against the law to share private information. Model information is part of a private contract, so it is not clear that holding information to be in compliant with a US law might actually make you in violation of a Canadian law.

Moreover, the "hosting in the us" thing is not entirely clear either. ISPs are exempt (always have been on everything), so where does the publishing actually happen?

One lawyer in miami suggested that Canada would cooperate in this stuff. I am not so sure.

Finally, remember that the proposed "rule clarification" was shot down by the 10th circuit about 5 years ago. They said that making new law is the job of Congress, not the AG. I don't think that the US AG office will go over borders to find a test case - if they even manage to squeeze in a test case before all of my wise US friends get together and toss Bush and Ashcroft out on their ears.

I agree that they will not look across borders for a test case, that would be a stupid move on their behalf, but while hosts are basically exempt in this matter, a site hosted here could be shut down for non-compliance.

I agree, I hope .. enough of the American public will be able to see and remember what a fraud the Bush Administration has been since day one and come November, that's the last we'll see of them.
