It depends on how they link to you - right now Google has a problem with some of the ways people can link to you that will cause you to be the one they give the dupe ban to - if you need proof that it can be done to a competitor I can show you a fine example

It can also be dealt with through Google but it does take some time to start to get back your own listings that were removed because of this type of linking
