Depends on the original contract that he signed with you. If it says that all work product that he produces is the property of your company, its pretty straight-forward.
If he custom designed a script to sell to you and undercut his rates with the thoughts of reselling the script, you might run into more difficulty. If you bought a script from him and had it customized, then, that would make it a lot more difficult. Its should be documented clearly in the work document & quote. Best thing to do would be to ask him what his expectations are.
