I'm not a lawyer, but the one thing that I did see that you were missing from the 2257 info is the name of the person in charge of the records (I guess the gov't needs to know who's office door to knock on if they show up)

Hi,
As I got back in this business just a few months ago after doing 'normal' jobs for some years I would like to know more about this 2257 stuff. I have searched this forum and also searched with Google. I can find a lot of pages with the text (although the text on many sites differ in huge ways). But I can not find any good explanation of this law. Any link to a good explanation will be of great help to me. I'm wondering if and how this law is affecting webmasters from outside the USA. I'm European and my new website will be located on a server in Australia. O, and can somebody explain what "Custodian of Records" means. Is this the person / company that created the pictures / movies. Or is this the person / company owing the legal copyrights for the material. Thanks for your answers. Greetings from The Netherlands Paul |

Hi Paul,
I asked this, if youwant US traffic or listings on US hubs / Servers best thing to do is just comply, its not so hard. If you buy content or are promoting a programe you can use their disclaimer :-) |

![]() It's not that I don't want to comply. No problem with that.
But I first want to understand. Were can I find (understandable) information about this law. I have tried several webmaster forums, a lot of discussions about how this will influence the business but never have I found an explanation or reference to the law itself. Probably I'm not searching good enough. But within the enormous amount of postings and searchresults on Google it is very difficult to find the information. So I thought I check out some of the wellknown sites http://www.link-o-rama.com/ I can't find any reference to this law at all. http://www.smutgremlins.com/ only has this text on the opening page Quote:
has a complete page http://www.dangerdave.com.au/ which seems to me a lot of legal blahblah. I suspect the law is not only about putting such a text on your site. That's easy. What is more. ![]() |

link-o-rama.com doesn't have any pics other than sponsor stuff, so there's no 2257 link on there (but I really should slap one up just to be on the safe side)
My 2257 page is here: http://www.greenguymarketing.com/2257.html |

1. Do you live in the US or make visits to the US? 2. Is your server in the US? 3. Is the TGP/FreeSite/MGP (etc) to which you are submitting in the US? 4. Is your sponsor from which you may have received free content in the US or do you buy content from US suppliers? Saying yes to any of these MAY require you to place a 2257 statement on your pages. The first two questions are for self-protection as you or your server could be seized by the American authorities. Check your web hosting TOS (Terms of Services). If they allow adult content, they may require you to add 2257 either explicitly or implicitly (i.e. "customer must comply with all law, federal, state or local ... etc). The latter two have to do with ensuring compliance for your business partners. Failure to comply on 3 & 4, may not get you thrown in jail but these people may not do business with you should you not publish their 2257 information. Sponsors potentially could refuse to pay you if they require 2257 statments on all pages made by you with their content (whether you are in the US or not). Remember, I am not a lawyer but I play one on the Internet. Cheers, Art Last edited by ArtWilliams; 2005-02-20 at 09:04 AM.. |

Wouldn't it be easier to just stop submitting to xxxporntastic? Someone should ask them where their 2257 link. I can't find it. I don't have one, but I don't reject for it either.
2257 is for pussies! ![]()

Ofcourse I will put up such a page with the legal stuff (just to be on the safe side). But I must change some of the text because of laws within my own country. Don't you like doing business international. ![]() |

The few pages that I do have online with sponsor content have the 2257 info on them if I remember correctly.
But it's a moot point, as I have linked up my 2257 page from the index ![]() |

![]() Speaking of 2257, is anyone aware of any LL's rejecting for no 2257 link? Most the time I just use text on the bottom of my freesites stating the material is compliant with 2257, etc... but without a link. |
