You are 100% right aj, but as Useless pointed out, not everyone is going to go for it. People in this biz are rebels by nature, not followers of rules, and as long as some believe there is money to be made in giving pussy away, they will do so.

Getting away from your local laws sounds easy though, register a dot com and host it with an American or Dutch, or Canadian or any host outside of your country. Why would you need a .de domain?

One cannot really get away from it... it's more like staying below the radar. This
course of action would still be illegal because one would operating from within Germany.
So any German webmaster doing that would still has to hide his identity by registering
whois-protected domains. Whois protection again isn't very popular in the biz, I
had to learn this lesson already.

But again, I do not understand paysite-owners and content-producers giving away
pussy for free. I don't really see any advantages...

The point I was making is that does not work. Just because you host it abroad, and don't use your country's domain name does not make it legal, you still get arrested, you still go to jail.

Back in the 1990's when we had similar laws to the ones Germany has now, there were plenty of people in prison over here for doing what you suggest.
