It's time to go public - this has gone out of control and needs to be addressed

After careful thought and on the advice of intelligent people I trust (some from this board), I am deciding to go public.

Xxxjay's actions and words have hurt my reputation, my business, and have cost me both time and money.

With this thread I hope to accomplish 4 things:
1) Clear my name
2) Have my stolen material and stolen site removed from the web
3) Re-establish business with people that I have lost as a result of xxxjay's words.
4) Establish some ethics in regards to this matter.

I have emailed and icq'd Jay in the past about this, but received no response. Jay, if you want to discuss this matter over the phone privately, contact me for my number.

I have never tried to screw over anybody. I realize we are all competitors, but I try my best to be an ethical competitor and a helpful "ally" to people I work with. If I make a mistake, I try fix it, and overcompensate people if I can. Back when I was a newbie people helped me (thank you to those that helped me and are reading this), and I now help newbies. You can have complete confidence when doing business with me, and I know there are many people out there that can vouche for my goodness of character.

And finally, Jay, this is not an attack on you. I am only trying to have things made "right."

I've done a lot of dealings with Kush and have many conversations online and over the phone with him and he has been nothing but an upstanding, ethical, polite, gentleman who is a pleasure to do business with. It makes me sad to hear someone has "ruined his reputation" because Kush is truly one of the good guys in this business and sometimes those are few and far between.

Anyhow I have no opinion on the situation because I don't really have that much knowledge on it, I just know that Kush is a man who is true to his word and I would trust him immensely.

I think this all demonstrates that we shouldn't become obsessed with getting top placements for prize keywords. It may be more work initially, but if you don't put all your eggs in one basket and instead try to build mutiple streams of income it will add up eventually, and you won't need to panic when one of your keywords drops out of first place.

Kush, I know you a long time, and like and respect you. But I have to say this:

SE wars are dirty business. You cannot have thin skin and do SE work. You should go into KNOWING that if you reach #1, you will be copied a bajillion times. Unless you can spoff/encrypt pages without penalty, there is not much you can do.

You know how webmasters copy successful TGP ads/galleries? Well, SE work is that times 100. And it has been like that since the days of the 'Super Bowl' script.

Steven and JenC, thank you for your kind words. I really appreciate it.

People have probably copied my TGP galleries, free sites, and SE work before, and while I feel good saying that I have never copied anybody's work, I no doubt have come up with ideas because of what I have seen other people do in the past.

But with all due respect to Jay, he knows enough about SE's that he can get good listings through his own original, hard work.

But what he's doing is cutting corners in a very dirty and unethical manner. I mean let's face the facts, he stole my work, and the proof is still sitting right there for anybody to see.

But I think he stole my material so he could have just another site quickly and easily so that he could use it to link to his own sites.

It's very shitty indeed.... |pissed|

Kush, I have some very bad news for you...

In the real world, every day people copy other people's ideas in marketing and advertising and attempt to use them to get ahead. Many times, they don't even bother to change the words at all, except to point to their product rather than another one.

In TV, reality shows got popular, and suddenly everyone had one. Who wants to be a Millionaire strikes it big, and suddenly everyone wants an evening, 1 hour, mega dollar game show.

To be totally honest with you, your page on reality porn is in my bookmarks, and has been for a while. What do you think it is there for? Once your marketing concept is out there in the public and can be viewed, it will be copied, duplicated, and mimiced all over the net for traffic. I regularly look at pages that return good results for various phrases looking to see what the patterns are. It's normal. I'm not just going to read webmaster boards and do what is suggested, come on!

As someone else suggested, get thicker skin. It happens, it sucks, move on and build a better mousetrap yet. :-)

Alex, yes, I realize all of this. And of course I do my best to prepare for the inevitable, always planning things through and acting on my best interests.

But tell me you wouldn't be upset if I publicly badmouthed you, lectured you on ethics, and then turned right around and stole your work? I bet you wouldn't be happy - and I certainly am not.

I've never had any dealings with Jay, so I can't comment about that.

But I do remember that you used to submit a lot of sites to a link list I used to run. Your sites were on auto-approve because I knew they wouldn't need checking.

I can accept the fact that we study each others pages and learn to improve what we do regarding SE's but that doesn't mean you can copy the page in such a way that you leave the other webmasters url on it. Thats a little too obvious.

I'm not in the links list biz altho I do submit to them.

I think we all need to realize what we're talking about when we say 'copy' here.

Copy'ing as in emulating or mimic'ing an idea is one thing. Lets say Coke hires a female singer to promote their product and it works, so pepsi hires one too.

That's not whats happened here.

Whats happened instead, pepsi has taken one look at that coke commercial and said "wow that singer is good" and has instead simply COPIED the commercial, removing most of the Coke paraphanalia from it, and replaced it with pepsi logos.

That's illegal, that's immoral, its flat out wrong. I mean, he even copied the copyright notice that Kush uses on his pages.

That said, I dont fault jay, I dont fault kush. I think its a bad situation here that has gone way out of control. I'm hoping that kush and jay settle it and it works out to make some sweet deals for both of them.

But in the end, you guys need to realize its not a matter of copy'ing _ideas_ here... its a matter of actually copying _CONTENT_ which should be abbhored in this industry or any other.

If you are declaring copyright on your original work, pages etc, that is enough to give one some legal recourse against thieves.



For the record, it IS okay to look at other people's websites and get ideas from them, and develop those ideas into something original for your own sites.

It is NOT okay to right-click> view source> 'save as', then download all the persons graphics and images, then change the sponsor codes to your own and pass it all off as your own site.


But that should be obvious, a given, a no-brainer..... worthy of a "(duh)". |idea|

CD Smith: Agreed (duh!). There is a VERY fine line on this sort of thing where you go from paying tribute to, well, theiving. I am not passing judgement in this case (I honestly don't want to spend the time to read all the stuff, and there is no upside to having an opinion!).

Anyone who hasn't looked at the top 10 sites on google for their keyword phrase to see what is going on is missing the boat. Reverse engineering is a full time job! :-)
