Using non-nude model images, fair use?

If you were to have a page dedicated to a model and wanted to use a small thumbnail image of her, non nude or cropped from nude (ignore the 2257 debate on this for a moment), is that considered fair use?

I could pull one from some sponsor content but I may be breaking their policies by promoting their sites AND others on the same page as that image. So I'll be staying away from doing that. Is there anywhere I can get images to use and have them be considered fair use?

Do Canadian/US magazines pay fees each time they use a small image of an actor each time they write a blurb about them? I don't think they do. But, then again, I'm not a lawyer.

New photos are a different matter. If it is commerical advertising then yes they do pay. Either it is from files they have on hand (and own the rights to) or they buy stock photography and the rights to use the photo.

Now that I think of it, half of the IMDB pages I visit don't have actor/actress portraits. Maybe fair use doesn't cover this...

For content that the program owns exclusively, it should not be a problem. Many programs only offer content they've licensed only for themselves, not affiliates; and so you would not be covered to crop a pic and host it on your own domain.

btw- I saw that you just signed up for our program. Our content is all shot in house, so feel free to use whatever you need:-)
