Actually, he is doing exactly the same thing John Ashcroft did - pick a higher profile situation that the government has lost at, and send it back to the courts for consultation. That is a "holding pattern" action that will take probably 2 or more years to resolve itself - and after another loss, likely to get booted up further.

I am actually starting to think the Bush people have no time and no stomach for this stuff. They keep punting, keep making "we are serious about obscenity" statements, and then either pushing old stuff back to the courts or threatening us with laws that the courts already struck down.
