I really like Tommys idea

to help with that maybe it would be good to get the site archived in the way back machine

It's not in there yet but I've noticed that searching for a site there usually gets them to go and start indexing it.

Thats been my experience anyway.

The DMCA violation can be sent directly to Google and Yahoo. I have done so on at least two occasions and the infringing sites were removed from the index within a matter of weeks. Here’s the Google link: http://www.google.com/dmca.html#notification

Once Google finds in your favor this is what the search will look like (note the bottom of the page):

Information is stored at Chilling Effects. This is an example of a report I filed.

The same can be done for the index proper. I noticed someone filed a DMCA violation that applied to one of my targeted SERPs. Check out (again notice the bottom of the page):

I did not get an approval notice. The DMCA notification just showed up in the SERP. However, on another matter, when Google disagreed with me they did e-mail to suggest that I provide more information.
