YEAH! This could be the best 2257 news in years!

Experts on the Regulatory Flexibility Act said that the Justice Department has failed to satisfy requirements of that legislation.

WASHINGTON — Experts on the Regulatory Flexibility Act asserted in a letter submitted during the recent 2257 public comment period that the Justice Department has failed to meet their requirement under the RFA to consider the impact of 2257 regulations on small businesses.The letter, primarily authored by David E. Frulla, a partner in the firm Kelley, Drye, Collier & Shannon, honed in on the fact that the Justice Department apparently has done no research whatsoever on the economic impact of 2257 and the burden that compliance would impose on small businesses within the industry.

FSC Chairman Jeffrey Douglas told XBIZ that the RFA concerns cited by Frulla in his letter are “earth-shattering” for the Justice Department’s continuing efforts to enforce 2257.

“I don’t know how the Justice Department is going to proceed,” Douglas said. “If they ignore [the RFA claims] the statute will be enjoined — hopefully root and branch. If they comply, then they have to start all over again, and consider the economic impact of the entire statute.”

Good... but I'm very skeptical that this would bring about the end of 2257 woes.

No, it won't completely end the woes but at the very least it will send the DOJ back to do more RFA relevant research before writing the regs. The resulting regs would likely require far less complex record keeping requirements.

Never underestimate the willingness of a bureaucrat to jump headlong into anything that will ensure their job for the next ten years - and mandate the wasting of more of our tax dollars.

I for one, fully expect the government to waste even more of my time and money with no regards for the kind of work and expense a particular "requirement" causes the working public, let alone, the legality of it.

It's very possible that someone will be offered a cushy job to perform to the study and possibly a group of people will be involved. They may meet once a quarter for the next decade and discuss what to do, get paid an annual salary and never realy work on it.

I met a guy that was part of a committee to build a statue in Washington, DC for some ex-President. I can't remember who. He had been on the comittee for 12 years at the time collecting his pay check. They met in DC twice a year, stayed at the Westin and partied pretty hard on your tax dollars. They knew that if they completed the task they would lose 2 free vacations and a 5 figure bonus.

This may go on for a generation or more.

I was reading this article the other day. Looks like the religious right is losing a little power in DC.
Headed into the 2008 election season, Christian conservatives are weary. Their movement has lost iconic leaders and the Republican presidential field is uninspiring.
add to that the fact that numb nuts does not have a lot of time in office and he is without his partner in crime Alberto G.

With all of these developements it makes me wonder if 2257 will be for primary producers only sometime in the future.
