RawAlex: Everything that we have seen from Acacia indicates otherwise on giving back anything if their patents are proven invalid. Anyone who saw the material they sent out would tell you the same. Acacia exec Robert Berman himself said in an interview with D$ that they would do not do that and gave his reasoning.

I know that has been claimed, but I would like to see it in print with Acacia signed off on it.

Companies mainly settle, imo, for the following:

1. Don't have or don't want to spend the cash to defend it
2. Poor representation
3. Don't want to go through discovery
4. Forced by injunctions because they did not deal with it appropriately in the first place

No one settles because they agree with the patents. That is universal as far as I can tell.
