I do a lot of spanking stuff and basiclly I am covering my ass (good with spanking, eh?) and making sure I have documents on it all. Any pic I have where two people are even touching each other....hell where a person is touching themselves ..I will document or pull the image. Since spanking roughly falls under a combination of violence and sex it makes sense to make sure everything is in order.

Yep. I forget the exact wording, but the 2257 regs speak of the depiction of sadistic and/or masochistic sexual activity.

Now you and I might recognize that the altruistic act of showing gorgeous models, dancers and porn stars the error of their ways in a - shall we say - old fashioned manner (and filming the same in loving detail) rises above such a base description.... but sadly, our government does not.

yes it does BUT it is a highly specialised market - almost like the gay side of things is a market rather than a niche. You wil get some sales with a spanking site if you don't know much about the spanking world but the real sales come from knowing all the terms and stuff within the community. The spanking community is nearly as complex as any other fetish community I have worked in.

Here's the relevant text, copied from the ever-helpful Cornell Law US Code website, with links to the pages the text is pulled from :

2) “sexually explicit conduct” means actual or simulated—
(A) sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex;
(B) bestiality;
(C) masturbation;
(D) sadistic or masochistic abuse; or
(E) lascivious exhibition of the genitals or pubic area of any person;

The applicable text of the ACTUAL 2257 statute (not the rules, which are what changed, the DOJ has no power to change the statute):

(h) As used in this section—
(1) the term “actual sexually explicit conduct” means actual but not simulated conduct as defined in subparagraphs (A) through (D) of paragraph (2) of section 2256 of this title;


So, while point (E) of the section in 2256 is excluded from material requiring recordkeeping, (A) - (D) are covered, including "sadistic or masochistic abuse", which spanking would fall under.

IANAL, but the way I read this you'd best have docs for spanking even if the spankee is wearing full body armor
